Terms of Service

Welcome to FamilySpoon. By creating an account or using our service, you agree to these Terms of Service. Please read them carefully. If you do not agree, please do not use FamilySpoon.

1. Acceptance of Terms

By accessing or using FamilySpoon, you agree to be bound by these Terms of Service and our Privacy Policy. These terms apply to all users, including visitors, free-tier users, and paid subscribers. If you are using FamilySpoon on behalf of a family or group, you confirm that you have the authority to accept these terms on their behalf.

2. Your Account

To use FamilySpoon, you must create an account with a valid email address and a secure password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must be at least 13 years old to create an account.
You must provide a valid email address.
You are responsible for keeping your password secure.
Accounts are non-transferable.

If you believe your account has been compromised, please contact us immediately at support@familyspoon.app.

3. Your Content

You retain full ownership of all recipes, images, notes, and other content you create or upload to FamilySpoon. We do not claim any intellectual property rights over your content.

By uploading content, you grant FamilySpoon a limited, non-exclusive license to store, display, and transmit your content solely for the purpose of providing the service to you. This license exists only to make the app work. If you delete your content or your account, this license ends.

AI-generated images you create through FamilySpoon (recipe illustrations, cookbook covers) belong to you. We make no claim of ownership over the outputs. Per OpenAI's API terms, users retain rights to outputs they generate through the API.

Voice notes you record may capture the voices of other people. By saving a voice note, you confirm that everyone who can be heard in it has agreed to the recording being stored by FamilySpoon and played back by the members of the cookbook the recipe belongs to. Obtaining that consent before you save is your responsibility.

You are solely responsible for ensuring you have the right to upload and share any content you submit to FamilySpoon, including recipes transcribed from cookbooks, websites, or other third-party sources. You agree to indemnify and hold FamilySpoon and its operators harmless from any claims, damages, or liabilities arising from content you upload that infringes on the rights of others, including intellectual property rights.

4. Acceptable Use

You agree to use FamilySpoon in a lawful and respectful manner. You may not:

Use the service for any illegal purpose
Upload content that infringes on the rights of others
Attempt to scrape, crawl, or extract data from the service
Reverse engineer, decompile, or disassemble any part of the application
Interfere with or disrupt the service or its infrastructure
Create multiple accounts to circumvent plan limits
Share your account credentials with others
Use AI image generation to produce images of copyrighted characters, trademarked logos, real people without their consent, or sexually explicit or otherwise unlawful content
Record or upload audio that includes people who have not consented to being recorded, stored, and played back to the cookbook's members
Share public recipe links containing content that violates these acceptable-use rules

We reserve the right to suspend or terminate accounts that violate these terms.

In addition to full account suspension or termination, we may apply targeted, reversible limits to resource-intensive features (including AI-assisted recipe scanning and import) for accounts whose use appears automated, excessive, or otherwise abusive. Such limits may be applied in whole or in part, without prior notice. Standard account access, including viewing and editing existing recipes, remains available unless these terms have otherwise been violated.

5. Subscription and Payments

FamilySpoon offers a free plan (Taster), recurring paid subscriptions (Family Edition, Heirloom), and one-time purchases (Gift Cookbook, image packs). Payments are processed by Stripe.

Recurring subscriptions.

Subscriptions automatically renew at the end of each billing period.
You can cancel your subscription at any time from your account settings.
Prices may change with notice. Existing subscribers will be notified at least 30 days before any price increase takes effect.
We do not offer partial refunds for unused time within a billing period.

One-time purchases.

The Gift Cookbook is a one-time fee that grants lifetime access to the Gift tier. It does not renew and is non-refundable.
Image packs are one-time add-ons that grant additional AI image generations. Image pack purchases are non-refundable, and unused credits do not expire.
Applicable taxes are calculated and collected by Stripe where required.

All payment processing is handled securely by Stripe. FamilySpoon does not store your credit card information.

6. Cancellation

This section applies to recurring subscriptions. One-time purchases (Gift Cookbook, image packs) do not auto-renew and therefore have nothing to cancel.

You may cancel your subscription at any time. When you cancel:

You will retain access to your paid features until the end of your current billing period.
After your billing period ends, your account will revert to the free Taster plan.
Your recipes are never deleted due to a downgrade. All your content remains accessible.
You can re-subscribe at any time to regain access to premium features.

We believe your recipes are yours regardless of your subscription status. Cancelling a paid plan will never result in lost recipes.

7. Data and Export

You can export your full account data at any time from your account settings. The export is a ZIP file containing your recipes and metadata in both CSV and JSON formats. Recipe images are stored on a separate CDN and are not bundled in the export; the image URL for each recipe is recorded in both files so you can download them individually. We believe in data portability and will never hold your content hostage. If you choose to leave FamilySpoon, you can take all of your recipes with you.

8. Shared Cookbooks

FamilySpoon allows you to create shared cookbooks and invite other users to collaborate.

The cookbook owner manages membership and cookbook settings. Once a recipe is added to a shared cookbook, only the owner can edit, delete, or publicly share it. Members can add recipes and leave the cookbook at any time.
Recipes added to a shared cookbook, including any voice notes recorded on them, remain in the cookbook and under the owner's control after the contributor leaves.
Removing a member revokes their access to the shared cookbook immediately.
When you contribute a recipe, your display name is visible to other members.
Your subscription determines which features you can use, regardless of whose cookbook you are working in.

You are responsible for the content you contribute to shared cookbooks.

9. Service Availability

We strive to keep FamilySpoon available 24 hours a day, 7 days a week. However, we cannot guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users in advance of any planned downtime.

10. Limitation of Liability

FamilySpoon is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the service.

FamilySpoon uses AI to extract recipes from photographs, scanned documents, voice recordings, and pasted text; to translate, illustrate, and generate cookbook covers; and to suggest recipes via the AI Recipe Finder. AI-powered suggestions are based on automated classification of your recipes and may not accurately reflect ingredients, dietary suitability, or allergen content. AI output can contain errors, including misread ingredients, incorrect quantities, and skipped steps. You are responsible for reviewing and verifying all AI-generated content before relying on it for cooking, especially where allergens, dietary restrictions, or food safety are concerned. Recipes on FamilySpoon are not medical or dietary advice.

FamilySpoon is not responsible for content that users upload, including content that infringes on the copyright, trademark, or other rights of third parties. Responsibility for such content lies with the uploading user (see section 3).

To the fullest extent permitted by law, FamilySpoon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill.

Our total liability for any claim arising from or related to the service shall not exceed the amount you paid to FamilySpoon in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service. In the event of termination for cause:

We will notify you by email with the reason for termination.
You will have a reasonable opportunity to export your data before your account is permanently deleted, unless the violation is severe.
No refund will be issued for the remaining portion of a billing period.

You may also delete your own account at any time from your account settings.

12. Changes to Terms

We may update these Terms of Service from time to time. If we make material changes, we will notify you by email or through a notice within the app at least 14 days before the changes take effect. Your continued use of FamilySpoon after the changes take effect constitutes your acceptance of the updated terms. If you do not agree to the new terms, you should stop using the service and delete your account.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of FamilySpoon shall be resolved in the courts located in the State of Florida.
